I sent PayPal this message:

The dispute for a refund was escalated by the seller to a claim, and PayPal decided not to issue the refund because the dispute policy does not apply to the quality of the goods/services purchased.

This is not the case here. The dispute was not about the quality of the service purchased. The dispute was initiated because the seller did not provide the service for the period of time I paid for, which clearly qualifies as goods not received.

The service was paid to the seller on 15 June 2011, to be provided from 15 June 2011 to 14 July 2011. The seller unilaterally suspended the service on 23 June 2011, without making a pro-rated refund for the time the service will not be provided.

Thus, I paid for 30 days of service, and only received 8 days."

If PayPal doesn't reconsider their decision (which I don't believe they will), I'll just take them to court and ask for what we call here "moral damages". That's pretty easy to do - I'm always sueing some bank or credit card company - and, best of all, free. Actually, this goes beyond "moral damages", I'm pretty sure it qualifies as fraud or something like that. I'll talk to my attorney next week.

As to LowPingGameServers, I'm filing a complaint against them with the BBB, and studying other possible direct measures.

that's the most stupid thing i ever saw, the problem wasnt the complaint about the quality, but the break of the contract by the other part... those guys at paypal must be more dumb than the ones that works for the old server...

That's usual with PayPal's support. If you ask them the same question 3 times on different days, you will probably get 3 different replies. A judge will only give them one reply, though.

"This client used racial comments towards our employees which is a violation of the terms of service he agreed to. Someone from PayPal now replied that "PayPal's dispute policies apply only to physical goods, not to services or other intangible goods". Under Brazilian Law, all parties involved in a civil or criminal lawsuit are considered equally responsible, so since LPGS has no representatives in Brazil, PayPal and the issuer of the credit card used in the transaction are going to face the charges alone.

I'm often interviewd by major Brazilian newspapers like O Globo (my latest interview is online on the Brasil Livre site) because of my countless individual lawsuits against abusive companies, besides class action suits conducted by the Brazilian Public Ministery based on facts I provided them. I'm getting in touch with my media contacts to get some heat on PayPal on this issue.

About LowPingGameServers, I'll try a few extrajudicial possibilities, like filing complaints against them with the BBB and other entities and massively contacting the American media about the case. If that doesn't get them to return the money they should have refunded me, I'll just hire an US attorney and sue them for everything they can be sued for.

This is not about the pitiful amount of money involved, it's a question of principle. Fortunately, I have plenty of financial resources to spend on this, and I don't care about how much I'm gonna win or lose.

No, leave them alone. They'd just delete the post and ban you (as I would if they posted here). Our forums have more members, topics and posts than theirs, anyways... not to mention spies.

By the way, I'd like to say that the massive support I've been receiving from you guys has not gone unnoticed. Who would have said we would ever see Rumple, Money and Crystal on the same topic without trying to kill each other AND fighting for the same cause? If anything, LPGS did us a service by bringing everyone back together again and forcing me to find a much more professional company with a far superior network, Nuclear Fallout Servers, which will benefit everyone.

Just found out on this lovely site - Screw-PayPal.com - that there's a major class action suit against PayPal going on in California right now. I've also just received the chargeback by the issuer of the credit card used in that payment that LowPingGameServers STOLE from me. If they insist with the dispute, they might have to face credit card fraud charges and have their PayPal account frozen.

I should be filing my individual lawsuit against PayPal for moral damages in the next weeks, based on all the trouble they caused me and on the illegality of much of their terms of service under Brazilian (and most countries) consumers defense laws, and, of course, denouncing PayPal to the Brazilian Federal Public Ministry, which will certainly lead the federal prosecutors to file a public class action suit against PayPal. I'm also already working together with major Brazilian newspaper O Globo on a report on PayPal's activities in Brazil. Then it will be the time for the avalanche of complaints against LPGS with every consumers defense institution or association I manage to find in the US, besides massively contacting the US media. I'll keep you all posted as the cases develop.
